Terms of Service

1. Acceptance of Terms
By downloading, installing, accessing, or using the FixUp Arena application ("App"), you agree to be
bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately
cease using the App.
2. Description of Service
FixUp Arena is a tournament management application for organizing and participating in football
tournaments. The App is provided for entertainment and organizational purposes only.
3. User Accounts
You are responsible for:
- Maintaining the confidentiality of your account
- All activities that occur under your account
- Providing accurate and complete information
- Notifying us of any unauthorized access
4. Prohibited Conduct
You agree NOT to:
- Harass, abuse, threaten, or harm others
- Upload malicious code, viruses, or harmful content
- Attempt unauthorized access to the App or systems
- Interfere with the proper functioning of the App
- Use the App for any unlawful purpose
- Impersonate any person or entity
- Upload content you do not have rights to
5. User Content
You retain ownership of content you upload (photos, videos, etc.). By uploading content, you grant us a
non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute such content
within the App for its intended purposes.
You are solely responsible for all content you upload. We are not liable for any user-generated content.
6. Termination
We reserve the right to suspend, ban, or terminate your access to the App at any time, with or without
notice, for any reason, including but not limited to violation of these Terms. Upon termination, your
right to use the App ceases immediately.
7. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND,
EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
We do not warrant that: (a) the App will function uninterrupted, secure, or available at any particular
time or location; (b) any errors or defects will be corrected; (c) the App is free of viruses or other
harmful components; or (d) the results of using the App will meet your requirements.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FIXUP ARENA, K²
FOUNDRY, ITS DEVELOPERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, data, or goodwill
- Any damages arising from unauthorized access or data breaches
- Any damages exceeding £100 (one hundred pounds)
- Any physical injuries occurring during tournaments
- Any actions or conduct of other users
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or
otherwise) and even if we have been advised of the possibility of such damages.
9. Indemnification
You agree to defend, indemnify, and hold harmless FixUp Arena, K² Foundry, and their developers,
affiliates, officers, directors, employees, and agents from and against any claims, damages,
obligations, losses, liabilities, costs, or expenses arising from: (a) your use of the App; (b) your
violation of these Terms; (c) your violation of any third-party rights; or (d) your content.
10. Assumption of Risk
By participating in any tournament organized through this App, you acknowledge that physical activities
carry inherent risks of injury. You voluntarily assume all risks associated with participation and
release us from any liability related to such activities.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without
regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the
courts of England and Wales.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited
or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force
and effect.
13. Changes to Terms
We may modify these Terms at any time by posting the revised Terms within the App. Your continued use of
the App after such changes constitutes your acceptance of the new Terms.
